White County Board provides tractor repair updates

The White County Board met Dec. 13 to provide tractor repair updates.

Here are the meeting's minutes, as provided by the board;

White County Board Meeting

December 13, 2016

7:00 p.m.

A special meeting of the White County Board begun and holden this 13th day of December 2016 in the Courtroom of the White County Courthouse in the City of Carmi.

Chairman Trout called the meeting to order at 7:00 p.m.

Clerk Dozier called the roll with Dosher, McAnulty, Usery, Puckett and Trout all present.

Chairman Trout welcomed Mr. McAnulty to the Board and asked him to lead the Board in the Pledge of Allegiance.

Chairman Trout asked the Board if they had received the minutes of the previous meeting and were there any additions changes for deletions to those minutes. Mr. Usery made a motion that the reading of the minutes of the previous meeting be waived and that the minutes of the previous meeting be approved as proposed in writing. Mr. Puckett seconded the motion. Motion passed 5-0 on roll call vote.

Chairman Trout asked the Board for payment of all current bills. Mr. Dosher made a motion to pay all current bills, seconded by Usery. Motion carried 5-0 on roll call vote.

Mr. Adam Allen, Director of the White County Ambulance Service stated that the service is in the process of gathering new and gently used coats to give to individuals in need of a winter coat. Mr. Adam stated that the Service was moving into the final stages of working toward Deaconess Hospital being in charge of the Ambulance Service medical control.

Mr. Doug Maier, White County Sheriff, was unavailable for the meeting and no report submitted.

The next 9-1-1 meeting will be held on January 16, 2017 at 6:00 p.m.

Mr. Brian Ray, County Engineer, stated that the County’s tractor was being repaired and that Alan Williams the Burnt Prairie Township Road Commissioner had made his tractor available to the Highway Department. Mr. Ray stated he wanted to thank Mr. Williams. Mr. Ray also stated that he had submitted a grant to the Highway Safety Improvement Program grant on the Epworth Road. He stated that the grant was awarded for 1.66 million dollars in which the County will have to come up with a 10% match which we can manage. He stated that in the grant he had asked that the shoulders of the road be at least 2 feet and the Department would like to see those shoulders at least 4 feet. However that will add an additional million dollars to the cost. Mr. Ray said he has a verbal agreement to increase the grant by another million but nothing in writing.

Mr. Don Puckett, stated that he had met with Mr. Jim Totten the EMA Director and he was going to start running a few public safety announcements on the radio and in the newspapers.

Mr. Chris Marsh, Coroner, stated that he had submitted his report in writing. He also stated that after closely watching his budget he was able to pay off the Coroner’s truck loan. He reminded the Board that the grant was not received this year and that is what had been paying for the vehicle. He stated that he was still $3,000.00 under budget even paying for the vehicle.

Chairman Trout asked the Board to open up the floor to nominations for Chairman. Mr. Usery made a motion to nominate David Dosher as Chairman, seconded by McAnulty. Mr. Usery asked that nominations be closed, seconded by McAnulty. Motion carried 3-0-2 on roll call vote with Trout and Dosher abstaining.

Chairman Dosher asked the Board to open up the floor to nominations for Vice Chairman. Mr. Usery nominated Don Puckett as Vice Chairman seconded by Trout. Mr. Usery made a motion that nominations be closed seconded by Trout. Motion carried 5-0 on roll call vote.

Chairman Dosher asked the Board to consider a travel expense ordinance. Mr. Denton Aud, State’s Attorney, explained the ordinance.

Ordinance 12-13-16

An Ordinance Establishing the Reimbursement of All Travel, Meal Lodging Expenses Of Officers and Employees In The County of White, Illinois

WHEREAS, White County, Illinois is a non-home rule unit of local government pursuant to Article VII, Section 8 of the 1970 Illinois Constitution;

WHEREAS, the Local Government Travel Expense Control Act, Pub. Act 99-0604, requires all non- home rule local public agencies, including counties, to regulate, by ordinance or resolution, the reimbursement of all travel, meal, and lodging expenses of their officers and employees by the effective date of January 1, 2017; and

WHEREAS, the County Board of White County has determined that it must comply with the Act by passage of this ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY BOARD OF WHITE COUNTY, ILLINOIS, THAT THE FOLLOWING ORDINANCE TO REGULATE THE REIMBURSEMENT OF ALL TRAVEL, MEAL, AND LODGING EXPENSES OF THEIR OFFICERS AND EMPLOYEES BE AND HEREBY IS ADOPTED:

Section I: Definitions The following words, terms and phrases, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:

Entertainment: includes, but is not limited to, shows, amusements, theaters, circuses, sporting events, or any other place of public or private entertainment or amusement, unless ancillary to the purpose of the program or event.

Travel: any expenditure directly incident to official travel by employees and officers of the County or by wards or charges of the County involving reimbursement to travelers or direct payment to private agencies providing transportation or related services.

Section II: Official Business for which Expenses May Be Reimbursed.

(1) An official of the County shall be entitled to reimbursement for travel, including meals or

lodging, related to the following types of official business:

a. Education conferences related to the duties of the officers of the County;

b. Site visits to current or potential vendors of the County (2) An employee shall be entitled to reimbursement for travel, including meals or lodging, related to the following types of official business: a. Education conferences related to the duties of the employee of the County; b. Site visits to current or potential vendors of the County

Section III: Maximum Allowable Reimbursement for Expenses

(1) Unless otherwise excepted herein the maximum allowable reimbursement for an employee or officer of the County shall be those rates set by Reimbursement Schedule of the Governor’s Travel Control Board in effect at the time the expense was incurred (2) The following exceptions shall not be controlled by the Reimbursement Schedule of the Governor’s Travel Control Board and shall be limited as indicated:

a. Mileage reimbursement will be readjusted each budget year by issuing IRS rate guideline.

b. Meals will be reimbursed at $30 per day.

c. Rooms will be reimbursed at a single rate room. d. There will be nor reimbursement for entertainment.

Section IV: Approval of Expenses

The Board must approve the following reimbursements for travel, including meals orlodging, by a roll call vote at an open meeting of the Board: (1) Any expense of any officer or employee that exceeds the maximum permitted in Section III; or (2) Any expense of any member of the Board.

Section V: Documentation of Expenses

Before any reimbursement for travel, including meals, or lodging, may be approved pursuant to Section IV, a standardized form for submission of travel, meal, and lodging expenses supported by the following minimum documentation shall first be submitted to the Board:

(1) An estimate of the cost of travel, meals, or lodging if expenses have not been incurred or a receipt of the cost of the travel, meals, or lodging if the expenses have already been incurred;

(2) The name of the individual who received or is requesting the travel, meal, or lodging expense;

(3) The job title or office of the individual who received or is requesting the travel, meal or lodging expense; and

(4) The date or dates and nature of the official business in which the travel, meal, or lodging expense was or will be expended. All documents and information submitted under this Section are public records subject to disclosure under the Freedom of Information Act, 5 ILCS 140/1 et seq.

Section VI: Entertainment Expenses

No employee or officer of the County shall be reimbursed by the County for any entertainment expense.

Section VII: Effective Date This Ordinance shall be in full force and effect from and after its passage.

Mr. Trout made a motion to adopt the travel expense ordinance, seconded by Usery. Motion carried 5-0 on roll call vote.

Mr. Denton Aud, State’s Attorney presented the following resolution for consideration of the Board:

RESOLUTION

WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor was created to provide services to State’s Attorneys in Counties containing less than 3,000,000 inhabitants; and,

WHEREAS, the powers and duties of the Office of the State’s Attorneys Appellate Prosecutor are defined and enumerated in the “State’s Attorneys Appellate Prosecutor’s Act”, 725 ILCS 210/1 et. seq., as amended; and,

WHEREAS, the Illinois General Assembly appropriates monies for the ordinary and contingent expenses of the Office of the State’s Attorneys Appellate Prosecutor, one-third from the State’s Attorneys Appellate Prosecutor’s County Fund and two-thirds from the General Revenue Fund, provided that such funding receives approval and support from the respective Counties eligible to apply; and,

WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor shall administer the operation of the appellate offices so as to insure that all participating State’s Attorneys continue to have final authority in preparation, filing, and arguing of all appellate briefs and any trial assistance; and,

NOW THEREFORE, BE IT RESOLVED that the White County Board, in regular session, this13th day of December 2016 does hereby support the continued operation of the Office of the State’s Attorneys Appellate Prosecutor, and designates the Office of the State’s Attorneys Appellate Prosecutor as its Agent to administer the operation of the appellate offices and process said appellate court cases for this County.

BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor are hereby authorized to act as Assistant State’s Attorneys on behalf of the State’s Attorneys of this County in the appeal of all cases, when requested to do so by the State’s Attorney, and with the advice and consent of the State’s Attorney prepare, file, and argue appellate briefs for those cases; and also, as may be requested by the State’s Attorney, to assist in the prosecution of cases under the Illinois Controlled Substances Act, the Cannabis Control Act, the Drug Asset Forfeiture Procedure Act and the Narcotics Profit Forfeiture Act. Such attorneys are further authorized to assist the State’s Attorney in the State’s Attorney’s duties under the Illinois Public Labor Relations Act, including negotiations thereunder, as well as in the trial and appeal of tax objections.

BE IT FURTHER RESOLVED that the office of the State’s Attorney Appellate Prosecutor will offer continuing legal education training programs to the State’s Attorneys and Assistant State’s Attorney.

BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor may also assist the State’s Attorney of this County in the discharge of the State’s Attorneys duties in the prosecution and trial of other cases, and may act as Special Prosecutor if duly appointed to do so by a court having jurisdiction.

BE IT FURTHER RESOLVED that the White County Board hereby agrees to participate in the service program of the Office of the State’s Attorneys Appellate Prosecutor for Fiscal Year 2017, commencing December 1, 2016, and ending November 30, 2017, by hereby appropriating the sum of $7,000.00 as consideration for the express purpose of providing a portion of the funds required for financing the operation of the Office of the State’s Attorneys Appellate Prosecutor, and agrees to deliver the same to the Office of the State’s Attorneys Appellate Prosecutor on request during the Fiscal Year 2017.

Mr. Usery made a motion to approve the State’s Attorney Appellate Prosecutor resolution, seconded by Puckett. Motion carried 5-0 on roll call vote.

Chairman Dosher stated that the next item on the agenda was to consider the appoint of Richard Dosher as Commissioner to the Mill Shoals Drainage District #3 for a term that will end on the First Tuesday of September 2019. Mr. Puckett made a motion to appoint Richard Dosher to the Mill Shoals Drainage District #3, seconded by Usery. Motion carried 5-0 on roll call vote.

Chairman Dosher stated that the County had advertised for bid for the liability insurance, inland marine, and building and contents insurance. Insurance Audit and Inspection has made recommendation that we stay with our current carrier HCC with local agent of First Bank in the amount of $102,599.00. Mr. McAnulty made a motion to accept the recommendation of Insurance Audit and Inspection and renew the insurance with HCC beginning January 1, 2017 through December 31, 2017. Motion seconded by Usery. Motion carried 5-0 on roll call vote.

Chairman Dosher asked the Board to consider the resignation of Mike Ray from the Egyptian Health Department Board. Mr. Trout made a motion to accept Mr. Ray’s resignation from the Health Department Board. Motion seconded by Dosher. Motion passed 5-0 on roll call vote.

Chairman Dosher asked the Board to consider the amendment of the 2017 Budget transferring $4,000.00 into Courthouse Maintenance of Building, $4,000.00 into Courthouse Maintenance to Equipment and $2,000.00 into Courthouse Maintenance Grounds from Contingent. Mr. Dosher asked Mr. Trout to explain the why this amendment was being done. Mr. Trout explained that during preparation of the budget he and Mr. Ray had informed the Sheriff that since the staircase in the Courthouse had been removed and an office placed there without the Board’s knowledge they would be removing all the maintenance money from the Courthouse budget. Mr. Trout stated that all the monies for maintenance was moved to contingent. Sheriff Maier stated that he wasn’t going to call Board members everytime a toilet needed fixed for snow needed to be plowed. Therefore, the need for a budget amendment. Mr. Trout made a motion to amend the 2017 Budget. Motion seconded by Usery. Motion carried 5-0 on roll call vote.

Chairman Dosher asked the Board to consider the following maintenance resolution.

COUNTY MAINTENANCE RESOLUTION

RESOLVED, by the County Board of White County, that $400,000.00 is appropriated from the Motor Fuel Tax allotment for the maintenance on county or State highways and meeting the requirements of the Illinois Highway Code, and be it further

RESOLVED, that the maintenance sections or patrols be maintained under the provision of said Illinois Highway Code beginning January 1, 2017 and ending December 31, 2017, and be it further

RESOLVED, that the County Engineer/County Superintendent of Highways shall, as soon as practicable after the close of the period as given above, submit to the Department of Transportation, on forms furnished by said Department, a certified statement showing expenditures from and balances remaining in funds authorized for expenditure by said Department under this appropriation, and be it further

RESOLVED, that the County Clerk is hereby directed to transmit two certified copies of this resolution to the district office of the Department of Transportation

Chairman Dosher asked the Board to consider the resolution appropriating funds for the payment of the County Engineer’s Salary. The resolution is as follows:

Resolution Appropriating Funds for the Payment of the County Engineer’s Salary

Section 17-CS193-0-AC

WHEREAS, the County Board of White County has adopted a resolution establishing the salary of the County Engineer to be $91,485.00 (95%) percent of the recommended salary for the County Engineer as determined annually by the Illinois Department of Transportation, and

WHEREAS, the County Board of White County has entered into an agreement with the Illinois Department of Transportation for transfer of federal funds to pay one-half of the salary paid to the County Engineer.

NOW THEREFORE, BE IT RESOLVED, by the White County Board that there is hereby appropriated, the sum of Forty five thousand seven hundred forty two dollars and 50/100 dollars ($45,742.50) from the County’s Motor Fuel Tax funds for the purpose of paying the County Engineer’s salary from 1/1/2017 to 12/31/2017, and

BE IT FURTHER RESOLVED, that the White County Board hereby authorizes the Department of Transportation, State of Illinois, to transfer Forty five thousand seven hundred forty two dollars and 50/100 dollars ($45,742.50) of Federal Surface Transportation Program Funds allocated to White County to the Department of Transportation in return for an equal amount of State funds.

Chairman Dosher asked the Board to approve the annual load limit resolution.

RESOLUTION

BE IT RESOLVED, by the County Board of White County, Illinois, in a special

meeting held in the Court House in the City of Carmi on December 13, 2016, that a

load limit be imposed on County Roads in White County, Illinois, for a period of

ninety (90) days. This resolution becomes effective upon publication of same as

road conditions warrant. The load limit shall be as follows:

Chairman Dosher asked the Board to consider the following resolution appointing him to the Board of Review. The resolution is as follows:

RESOLUTION FOR APPOINTMENT TO THE BOARD OF REVIEW

WHEREAS, the County of White, State of Illinois, is a county under township organization having a population

of less than one million, and;

WHEREAS, 35 ILCS 200/6-5 of the Illinois Compiled Statutes requires a county under township

organization with a population of less than one million to appoint a Board of Review, and;

NOW THEREFORE BE IT RESOLVED, by the County Board of White County, State of Illinois that David

D. Dosher be appointed to the Board of Review for a term beginning December 1, 2016 and ending

November 30, 2018.

Mr. Usery made a motion to appoint David Dosher to the Board of Review, seconded by McAnulty. Motion carried 4-0-1 with Dosher abstaining.

Chairman Dosher, stated that he would like to thank Wes Trout for his service as County Board Chairman. He stated that he would continue in the same path as Mr. Trout. Chairman Dosher stated that he would like to be able to get and keep a balance budget just like Mr. Trout and that he had no interest or vendetta against any elected or appointed official. Chairman Dosher stated that he wanted to do what was in the best interest of the County and the taxpayers.

Chairman Dosher stated that he would now make his Committee appointments.
