Village of Freeburg Legal & Ordinance Committee met April 26.

Here is the minutes provided by the Committee:

The meeting of the Legal and Ordinance Committee was called to order at 5:30 p.m. by Chairperson Lisa Meehling on Wednesday, April 26, 2017, in the Freeburg Municipal Center. Members attending were Chairperson Lisa Meehling, Trustee Mike Blaies, Trustee Dean Pruett, Trustee Matt Trout, Mayor Seth Speiser (absent), Village Clerk Jerry Menard, Trustee Denise Albers, Trustee Ray Matchett, Zoning Administrator Gary Henning, Public Works Director John Tolan, Village Administrator Tony Funderburg and Office Manager Julie Polson. Guests present: Janet Baechle and Scott Hamann.

A. Old Business:

1. Approval of March 29, 2017 Minutes: Trustee Matt Trout motioned to approve the March 29, 2017 minutes and Trustee Dean Pruett seconded the motion. All voting yea, the motion carried.

2. Zoning Report/Nuisance Properties: Zoning Administrator Gary Henning Said the pod was moved yesterday, Mr. Brown has until May to get his junk cleaned up. There were 8 trucks/cars tagged this month, and all 8 have been corrected.

B. New Business:

Ordinance #1625 - An Ordinance Amending Chapter 40 of the Revised Code of Ordinances (Add Limousine Definition to the Zoning Code and also as a Special Use in an Agriculture District): Trustee Meehling advised the Combined Planning and Zoning Board met last Week with several residents in attendance. This recommendation has moved from that committee to here.

Trustee Matt Trout motioned to recommend to the full Board for approval Ordinance #1625, An Ordinance Amending Chapter 4O of the Revised Code of Ordinances (Add Limousine Definition to the Zoning Code and also as a Special Use in an Agriculture District) and Trustee Dean Pruett seconded the motion. All voting yea, the motion carried.

2. Cemetery Road: Village Administrator Tony Funderburg said this is about the Village taking ownership of Cemetery Road and then turning it over to the Township. In this letter to the County, We are going to ask them to maintain the bridge, and also let them know the Township is going to take it over. Public Works Director John Tolan has already met with Dale and Norm Etling, so Norm knows we are going to turn it over to Freeburg Township. John said the more roads Freeburg Township takes over the more income they get.

Chairperson Meehling asked for a motion to amend the agenda to hear public participation before the executive session.

Trustee Dean Pruett motioned to amend the agenda to hear Public Participation before the Executive Session and Trustee Matt Trout seconded the motion. All voting yea, the motion carried.

C. General Concerns: None.

D. Public Participation: Janet said FWCC has 100th anniversary and would like a proclamation at Monday's meeting to have at their open house on Sunday the 7th. She will get info to Gary.

Executive Session 5:40 p.m.

Trustee Matt Trout motioned to enter into Executive Session at 5:40 p.m. citing litigation, 5 ILCS, 120/2-(c)(11), and Trustee Dean Pruett seconded the motion. All Voting aye, the motion carried.

Executive Session Ended 6:35 p.m.

Trustee Matt Trout motioned to reconvene the regular session of the Legal/Ordinance Committee meeting at 6:36 p.m. and Trustee Dean Pruett seconded the motion. All voting yea, the motion carried.

E. Adjourn: Trustee Matt Trout motioned to adjourn the meeting at 6:37 p.m. and Trustee Dean Pruett seconded the motion. All voting yea, the motion carried.
