City of Fairfield Council met December 26.

Here is the minutes provided by the Council:

Meeting called to order by Mayor Brent Maguire at 6:00 p.m.

Prayer led by Pastor Robert Koker followed by the pledge of allegiance to the flag.

Also Present: Marty David, Wayne County Press; Silas Eckleberry, Assistant Police Chief; Andrew Miller, Fire Chief; Kevin Leonard, Water Department; Flo Simpson, FADC; and other citizens from the community.

The minutes of the meeting of December 12, 2017, agendas and bills of December 26, 2017 were sent out to those entitled to receive them. Mayor Maguire asked for approval of the minutes for the December 12, 2017 meeting. Motion by Alderman Stahl, seconded by Alderman Prince to approve the minutes of the meeting of December 12, 2017.

Absent: Simpson

Mayor Maguire declared motion carried.

Mayor Maguire asked for approval to pay the bills for the December 26, 2017 meeting. A motion was made by Alderman Barbre, seconded by Alderman Pottorff to approve the bills for payment.

Mayor Maguire declared motion carried.

Ordinance No. 17-1226-143/Annexation of Property – Attorney Darrin Rice told the Council that a petition had been filed by David Love requesting that property he owns be annexed into the City. This property is located immediately west of 915 Commerce Drive. A business is interested in purchasing this property and would like to have it annexed into the City and be zoned as a B-2 zone. Mayor Maguire asked for Council to approve this request. A motion was made by Alderman Pottorff, seconded by Alderman McGill to approve Ordinance No. 17-1226- 143 annexing this property into the City.

Mayor Maguire declared motion carried and Ordinance No. 17-1226-143 approved and duly adopted.

Ordinance No. 17-1226-144/Adoption of Sexual Harassment Policy – A Public Act was passed in November that amended the State Officials and Employees Ethics Act. This amendment requires all municipalities to pass an ordinance adopting a policy prohibiting sexual harassment. A motion was made by Alderman Prince, seconded by Alderman Griffith to approve this ordinance.

Mayor Maguire declared motion carried and Ordinance No. 17-1226-144 approved and duly adopted.

Ordinance No. 17-1226-145/Intergovernmental Agreement, Local Debt Recovery – This program is through the State Comptroller’s office and it assists various units of local government in collecting unpaid bills such as utility bills. To participate in the Local Debt Recovery Program we would need to enter into an intergovernmental agreement with the Comptroller’s office and then we would report the unpaid debt to them and they would match it with records for people about to receive tax returns or lottery winnings. The Comptroller’s office will deduct the amount from their check and pay the City what is owed. There is no fee charged to the City for this service but they do charge the person a small fee. We have already done the enrollment paperwork and we hope to be able to have this program fully implemented in January. Attorney Rice has reviewed the intergovernmental agreement and drafted the ordinance to authorize it. A motion was made by Alderman Griffith, seconded by Alderman Lisenbee to approve this ordinance.

Mayor Maguire declared motion carried and Ordinance No. 17-1226-145 approved and duly adopted.

Redevelopment Agreement, Kieffer Development Inc. – Mayor Maguire told the Council that we have a TIF Redevelopment Agreement with Kieffer Development Inc. for addition student housing at the college. After reviewing the documents there are some minor language changes that need to be made. This will be brought back to Council for consideration at the January meeting.

Miscellaneous – Mayor Maguire and the finance committee have met with an attorney that specializes in Tax Increment Financing concerning the loan that was made between TIF 1 and TIF 2. He is trying to help remedy the situation. However, in order to move forward, we will most likely have to retain this attorney for this purpose and Council should expect a resolution in the near future to approve this so the issue can be resolved.

Miscellaneous – Mayor Maguire wished everyone a Happy New Year and he is excited about the future of the City of Fairfield. We still are facing many challenges but we also have many opportunities to help transform Fairfield into a City that just didn’t find a way to survive during these difficult times but also found a way to thrive. He thanked all aldermen, employees, local business owners, and residents that have provided valuable input during the last several months he has been in office.

Miscellaneous – Alderman Prince reminded all residents that we have an ordinance in place concerning vicious animals and that owners are responsible for the actions of their animals.

Adjourn Meeting – Motion by Alderman Barbre, seconded by Alderman Pottorff to adjourn the meeting.
