Village of Freeburg Legal & Ordinance Committee met January 24.

Here is the minutes provided by the Committee:

The meeting of the Legal and Ordinance Committee was called to order at 5:30 p.m. by Chairman Dean Pruett on Wednesday, January 24, 2018, in the Freeburg Municipal Center. Members attending were Chairman Dean Pruett, Trustee Denise Albers, Trustee Ray Matchett, Trustee Lisa Meehling, Mayor Seth Speiser, Village Clerk Jerry Menard, Trustee Mike Blaies, Trustee Matt Trout, Zoning Administrator Gary Henning, Public Works Director John Tolan, Police Chief Mike Schutzenhofer, Village Administrator Tony Funderburg and Office Manager Julie Polson. Guest present: Janet Baechle.

A.Old Business:

1. Approval of December 27, 2017 Minutes: Trustee Ray Matchett motioned to approve the December 27, 2017 minutes and Trustee Lisa Meehling seconded the motion. All voting yea, the motion carried.

2. Zoning Report/Nuisance Properties: Zoning Administrator Gary Henning stated he and Trustee Pruett drove around town and found 8 items to check on. All of those items have been corrected or are in the process of being corrected.

B. New Business:

1. Review of Annexation Agreement: Village Administrator Tony Funderburg would like for this committee to review our current annexation agreement. If they see any issues with it, please let him know.

2. Change in Preliminary Plat Approval Time Frame: Tony explained our current code states when a preliminary plat is approved and the subdivision is being built in phases, the final approval can be extended to three years from the date of the preliminary plat approval instead of the normal one-year period. He would like to change the three-year deadline to five years. He stated Attorney Keck has reviewed this and said it makes sense. The committee was fine with the revision to the code.

3. St. Clair County Zoning Board of Appeals Hearing for Austin Wolf: Tony advised the applicant wants to run a metal fabrication business in an agricultural district at 4744 State Route 13. The committee had no objections to this request.

4. St. Clair County Zoning Board of Appeals Hearing for Carolyn Davis: The applicant is requesting a variance to subdivide a six-acre parcel instead of the 40-acre requirement at 8162 Red Ray Mine Road. The committee had no objections to this request.

Village Administrator Tony Funderburg called for an executive session to discuss litigation.

The regular committee session reconvened at 5:53 p.m.

C. General Concerns: None.

D. Public Participation: None.

E. Adjourn: Trustee Lisa Meehling motioned to adjourn at 5:53 p.m. and Trustee Denise Albers seconded the motion. All voting yea, the motion carried.
