Meeting called to order by Mayor Brent Maguire at 6:00 P.M.

Prayer led by Pastor Donna Blythe followed by the pledge of allegiance to the flag.

The minutes of the meeting of May 8, 2018, agendas and bills of May 22, 2018 were sent out to those entitled to receive them. Mayor Maguire asked for approval of the minutes for the May 8, 2018 meeting. Motion by Alderman Prince, seconded by Alderman Lisenbee to approve the minutes of the meeting of May 8, 2018.

Mayor Maguire declared motion carried.

Mayor Maguire asked for approval to pay the bills for the May 22, 2018 meeting. A motion was made by Alderman Barbre, seconded by Alderman Pottorff to approve the bills for payment.

Resolution No. 18-0522-269 – Authorizing Access License Agreement – We have received a request from an environmental remediation firm for access to the auxiliary building and the parking lot. Several years ago there was a petroleum spill at the Huck’s Gas Station and they are required to monitor the ground to determine the extent, if any, of off-site soil or groundwater contamination from the gas station. CW3M is the environmental firm secured by Martin & Bayley, the owners of the Huck’s Gas Station, and they will be installing monitoring wells into the ground. The wells will consist of perforated PVC pipe inserted 15 feet into the ground. Alderman Barbre wanted to make sure this company puts back the property in the same condition as it is before the work began. Other companies have been doing work along the city’s easements and he is not happy with how they have left the property. Attorney Rice told Alderman Barbre that there is language in the agreement that addresses this concern. The resolution authorizes the execution of two access license agreements, one for the auxiliary building and the second for the parking lot. A motion was made by Alderman Prince, seconded by Alderman Stahl to approve Resolution No. 18-0522-269 to enter into an access license agreement with Martin & Bayley Inc. to allow CW3M access to the city’s property.

Ordinance No. 18-0522-154 – Zoning Code Amendment – A public hearing was held at 5:45 p.m. concerning changing the property at 800 East Douglas from an R-2 zone to an R-3 zone. The owners of the property plan to purchase a manufactured home and put it on the property. A motion was made by Alderman Pottorff, seconded by Alderman Griffith to approve Ordinance No. 18-0522-154 amending the Fairfield Zoning Code changing the property at 800 East Douglas from an R-2 zone to an R-3 zone.

Mayor Maguire declared motion carried and Ordinance No. 18-0522-154 approved and duly adopted.

Motion to Set Public Hearing on Zoning Variance for 5 Esther Road – Recently the Zoning Board of Appeals met to consider a zoning variance for a set back and height restriction in an R-1 District for property located at 5 Esther Rd. The Zoning Board did not take action on this request and now we need to publish notice of a public hearing on this matter. We will plan to have the public hearing on June 26th and at that time the Council will consider and vote upon an application filed by Dustin Strange for this zoning variance. A motion was made by Alderman Pottorff, seconded by Alderman Lisenbee to set a public hearing to consider this zoning variance.

Date Change for Fireworks – We originally had fireworks scheduled for Saturday, July 7th but there is a conflict because of the Wayne County Fair. The new date for the fireworks will be Friday, July 6th and we will still get an additional 10% in fireworks. We are still accepting donations to help offset the cost of the fireworks.

City Wide Clean-up – Mayor Maguire told the Council that Republic brings an extra truck one day during the last week of the month for large items. They said they would bring an extra truck each day of the regular route for a clean-up week but they will charge $2.00 per household. This would cost the city around $4,500. The aldermen would like to have all residents reminded about the large item pickup day on the last week of the month. There is also a large dumpster located at the St. & Bridge Department for residents to use for large items. Mayor Maguire is still trying to find a way for residents to dispose of electronics. Data Lock from Mt. Vernon said they could send a truck to pick up electronic items and they have a minimum requirement to be here for three hours at a cost $100 per hour so it would cost the city $300. Lewis Scrap Yard also said they might be able to help the city with the disposal of old tires. They might be able to bring a dumpster for old tires and then we would pay them for the disposal. We would need to charge $1 or $2 per tire to help offset the cost.

Discussion of Zoning Ordinances – The current zoning ordinance states that for residential dwellings anyone wanting to add an accessory structure, such as a storage building, carport, detached garage, patio, or similar structures, needs a special exemption. In order to get a special exemption the zoning board would need to grant that exemption. A 15 days notice would need to be published prior to the zoning board meeting. Mayor Maguire questioned if that process was the original intent of the zoning code. It was the consensus of the Council to have the City Attorney prepare an ordinance to simplify this portion of the zoning ordinance.

Miscellaneous – Mayor Maguire went down to the interstate with Fire Chief Andrew Miller. The City’s ladder truck was used to display a large American flag at an Interstate 64 overpass as motorcycles passed by for the “Run for the Wall” as they headed to the Vietnam Wall.

Miscellaneous – Alderman David Simpson and his wife will be moving to the St. Louis area for a new job. Alderman Simpson has served as an alderman since 2003 and Mayor Maguire thanked him for his years of service to the city. Mayor Maguire will be making an appointment soon to fill the unexpired term of Alderman Simpson. He asked for Council members and the public to let him know if anyone has any recommendations of someone that might be interested in serving as alderman.

Executive Session – Alderman Barbre made a motion, seconded by Alderman Pottorff to go into Executive Session to discuss Section 2(c)(21) – discuss minutes of closed session meetings and Section 2(c)(1) – appointment, employment, compensation, discipline of employees of the public body.

Alderman Griffith left prior to the start of the Executive Session.

Return to Regular Session – Alderman Simpson made a motion, seconded by Alderman Prince to return to regular session.

Mayor Maguire declared motion carried and Council returned to regular session at 6:44 p.m.
