City of Albion City Council met May 7.

Here is the minutes provided by the council:

The Albion City Council met for a special council session on May 7, 2019 6:30 p.m. in the Albion City Hall. Mayor John Henze called the meeting to order and led the Pledge of Allegiance.

Council Members Present – Pat Hemming, Eric Eirikson, Eric Schmidt and Kim Dostal. Arriving at 6:38 Jordan Hinkle. Also Present – City Attorney, Maria Brownell and Rhonda Guy.

Motion to approve agenda by Eirikson and seconded by Schmidt. Motion passed 4-0.

Motion to approve minutes of April 16, 2019 council meeting was approved by Dostal and seconded by Schmidt. Motion passed 4-0.

The City Council of the City of Albion, State of Iowa, met in open session, at City Hall, 107 South Main Street Albion IA, at 6:30 P.M., on the above date. There were present Mayor John Henze, in the chair, and the following named Council Members:

Pat Hemming, Eric Eirikson, Eric Schmidt, Kim Dostal and arriving at 6:38 Jordan Hinkle

Absent:none

Vacant:none

Council Member Hemming introduced the following Resolution entitled “RESOLUTION OVERRIDING MAYORAL VETO OF RESOLUTION APPROVING CONSTRUCTION OF MISSISSIPPIAN WELL AND REPASSING RESOLUTION,” and moved that the same be adopted. Council Member Dostal seconded the motion to adopt. The roll was called, and the vote was: AYES:Hemming, Eirikson, Schmidt, Dostal

NAYS:Hinkle

Whereupon, the Mayor declared the following Resolution duly adopted:

RESOLUTION NO 2019-02 RESOLUTION OVERRIDING MAYORAL VETO OF RESOLUTION APPROVING CONSTRUCTION OF MISSISSIPPIAN WELL AND REPASSING RESOLUTION

WHEREAS the City of Albion, Iowa, has been directed by the Iowa Department of Natural Resources to take action necessary to meet water treatment quality standards; and

WHEREAS the City Council of the City of Albion, Iowa, met in regular session on April 16, 2019, at 6:30 p.m., to take action to address the city’s water quality issue; and

WHEREAS at said meeting, the City Council voted 3-2 in favor of a resolution to approve an alternative that would involve construction of a new Mississippian well, which is anticipated to be eligible for financing over a period of 30 years; and

WHEREAS the mayor vetoed the resolution with a written message to the council at the time of the veto as required by Iowa Code section 380.6; and

WHEREAS, after due consideration, the City Council now deems it in the best interests of the City of Albion, Iowa, to override the mayor’s veto and repass the measure.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Albion, Iowa, hereby overrides the Mayor’s veto of the City Council’s resolution on April 16, 2019.

BE IT FURTHER RESOLVED that the resolution approving the water provision alternative involving construction of a new Mississippian well is hereby approved and repassed in accordance with Iowa Code section 380.6.

BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to take all action necessary to implement this resolution.

Passed and approved this 7th day of May, 2019.

Eirikson stated, he supports Mayor, John Henze. However, he also supports his fellow councilmen in his decision to vote in support of construction of well.

Dostal motioned and Schmidt seconded to adjourn. Motion passed 5-0. Meeting adjourned at 6:42pm
