City of Fairfield City Council met May 26.

Here is the minutes provided by the council:

Due to COVID-19 the City Council meeting was held with limited in-person attendance and others joined the meeting via phone conference.

Meeting called to order by Mayor Maguire at 6:00 P.M.

Prayer led by David Mills followed by the Pledge of Allegiance. City Clerk Tina Hutchcraft called the roll:

Also Present: Ken Otey, WFIW Radio; David Mills, Wayne County Press; Keith Colclasure, Police Chief; Silas Eckleberry, Assistant Police Chief; Andrew Miller, Fire Chief; Dian Downs; Kayla Warren; DiElle Rogers; Flo Simpson; Jason Mason; and others from the community.

The minutes of the meeting of May 12, 2020, agendas and bills of May 26, 2020 were sent out to those entitled to receive them. Mayor Maguire asked for approval of the minutes for the May 12, 2020 meeting. Motion by Alderman McGill, seconded by Alderman Stahl to approve the minutes of the meeting of May 12, 2020.

Mayor Maguire declared motion carried.

Mayor Maguire asked for approval to pay the bills for the May 26, 2020 meeting. A motion was made by Alderman Barbre, seconded by Alderman Coale to approve the bills for payment.

NYOC Request for Ongoing Street Closures – Not Your Ordinary Church Pastor Jason Mason asked the Council to consider a request for closing SW 2nd Street between Main and Delaware from 6-10 p.m. every Saturday evening. This is when the church holds their services. He stated the reason for his request is due to safety concerns he has about people crossing the street and he said they like to hang out on the sidewalk and visit after services. Aldermen were concerned about setting a precedent and the liability of granting a closure every Saturday. The request was denied but the Council did say they would consider closing the street for the church’s special events.

Executive Session – Alderman Moore made a motion, seconded by Alderman Lampley to go into Executive Session to discuss Section 2(c)(1) – the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body and Section 2(c)2 – collective negotiating matters between the public body and its employees.

Return to Regular Session – Alderman Stahl made a motion, seconded by Alderman McGill to return to regular session.

Mayor Maguire declared motion carried and Council returned to regular session at 7:19 p.m. Appointment Resolutions – The following resolutions were presented to Council for approval.

Resolution No. 20-0526-333 City Collector appointment DiElle Rogers

Resolution No. 20-0526-334 City Treasurer appointment Kayla Warren

Resolution No. 20-0526-335 Economic Development Committee appointments 1 year - Amy Hart and Misti Titzer

2 year – Bryan Williams and Tim McBride

3 year – Jansen Vaughan, Jay Edgren, and Lynde Hickox

Alderman Griffith made a motion, seconded by Alderman Lampley to approve the above resolutions.

Mayor Maguire declared motion carried and Resolution No. 20-0526-333 through 20-0526-335 approved and duly adopted.

Resolution Setting the Dates for City Council Meetings – A motion was made by Alderman Barbre, seconded by Alderman McGill to approve the resolution setting the dates for the City Council meetings for the fiscal year.

Mayor Maguire declared motion carried and Resolution No. 20-0526-336 approved and duly adopted.

Ordinance Prohibiting Stopping or Parking on a Portion of SW 11th Street – Chief Colclasure is recommending that we place no parking or stopping signs on the east side of SW 11th Street because of the traffic at Taco Tierra. Because of the high volume of traffic in this area we want to be sure there isn’t a problem for emergency vehicles being able to get through there. This would commence from the north line of Delaware Street to 100 feet north of Delaware Street. A motion was made by Alderman Stahl, seconded by Alderman Coale to approve this ordinance.

Mayor Maguire declared motion carried and Ordinance No. 20-0526-212 approved and duly adopted.

Approving a Redevelopment Agreement with McBride Asset Management, LLC – The TIF Committee has met and they have recommended Council approve a redevelopment agreement with McBride Asset Management, LLC in the amount of $75,000.00. They have already invested a lot of money there and this would be used for the development of a retail area located next to Save-A-Lot. A motion was made by Alderman Coale, seconded by Alderman McGill to approve this ordinance authorizing a redevelopment agreement with McBride Asset Management, LLC.

Mayor Maguire declared motion carried and Ordinance No. 20-0526-213 approved and duly adopted.

Motor Fuel Tax Audit Report – City Clerk Tina Hutchcraft reported to the Council that we have received the Motor Fuel Tax Audit report showing the receipts and disbursements for January 1, 2017 through December 31, 2019. The records of the City are in agreement with the records maintained by the Department of Transportation.

FOP Contract – Approval of the FOP Contract has been tabled and will be brought back at a later date.

Miscellaneous – Alderman Lampley said the Governor is allowing court cases to resume so we might possibly be able to begin having municipal court in June.

Miscellaneous – Alderman Barbre asked for an update on the electric upgrade work that has been done at the power plant. Mayor Maguire stated the work with the portable substation has been completed and has removed the power plant from that circuit so we no longer have any generation capabilities there now. The underground feed has been fixed but there is work that still needs to be completed on some capacitors. We need to have additional discussion with Wayne-White concerning emergency back-up power. Alderman Barbre extended thanks to Wayne-White for their assistance.

Miscellaneous – City Hall will be reopening to the public on June 1st. Residents still have the option to pay their utility bill online.

Executive Session – Alderman McGill made a motion, seconded by Alderman Griffith to go into Executive Session to discuss Section 2(c)(21) – discuss minutes of closed session meetings; Section 2(c)2 – collective negotiating matters between the public body and its employees; Section 2(c)11 – pending litigation; and Section 2(c)(1) – the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body.
