City of Fairfield City Council met June 23.

Here is the minutes provided by the council:

The City Council meeting was held with in-person attendance and others joined the meeting via phone conference.

Meeting called to order by Mayor Maguire at 6:00 P.M.

Prayer led by Pastor Jason Mason followed by the Pledge of Allegiance.

Also Present: Ken Otey, WFIW Radio; David Mills, Wayne County Press; Keith Colclasure, Police Chief; Andrew Miller, Fire Chief; Dian Downs; Flo Simpson; DuWayne Nobles, Gas Department; Kevin Leonard, Water Department; Robert Kamp, Street Department; and other citizens from the community.

The minutes of the meeting of June 9, 2020, agendas and bills of June 23, 2020 were sent out to those entitled to receive them. Mayor Maguire asked for approval of the minutes for the June 9, 2020 meeting. Motion by Alderman Stahl, seconded by Alderman McGill to approve the minutes of the meeting of June 9, 2020.

Mayor Maguire asked for approval to pay the bills for the June 23, 2020 meeting. A motion was made by Alderman Barbre, seconded by Alderman Coale to approve the bills for payment.

Public Comments – Betty Ray addressed the Council about a dead tree at 211 NW 6th. She said it is the City’s responsibility to cut down. She said large limbs have fallen and she is concerned for the safety of people in that area if it is not cut down. She said it is not her responsibility to take care of it. Alderman Coale stated that last year he and Alderman Lampley had worked on a tree ordinance proposal. They had given the proposal to Attorney Rice for his review. Alderman Coale would like this proposal to be considered.

Public Comments – Glenna Coale stated the governor has passed a law where you can get an alcoholic drink to go because of COVID19. She asked if the Mexican restaurant in town can do this. Mayor Maguire stated that our restaurant license only provides for on-premise consumption so it is not allowed. The only way this can be changed would require an ordinance amendment and approval by Council.

Proclamation – Mayor Maguire declared June 23rd, 2020 as Rosalie Adkins Day. He read a proclamation of appreciation for Mrs. Adkins who will be retiring, Friday, July 3rd, after 27 years of serving as Service Coordinator for Community Care Systems Inc.

Street Closing Request – A representative with United Way Mobile Markets Program had previously spoken with Mayor Maguire about a street closing request and was planning to attend the meeting to ask Council to approve the request. The Mobile Markets program would give away between 300 and 400 boxes of vegetables and dairy products to those in need and had considered closing NE 3rd Street between Main and Court Street for this purpose. The representative was not in attendance at the meeting so Mayor Maguire stated this would have to be discussed at a later meeting.

Street Closing Request – NYOC Pastor Jason Mason asked for permission to close SE 2nd Street between Main and Delaware for Sunday, July 19th from 3 -10 p.m. He said they wanted to have church on the street. Aldermen asked if any noise complaints have ever been filed when they had an event on the street. Pastor Mason and Chief Colclasure both stated they had not received any complaints. A motion was made by Alderman Barbre, seconded by Alderman McGill to approve this request.

Purchase of Tractor and Rotary Mower – The City recently sold an old batwing mower because it had outlived its usefulness. Robert Kamp addressed the Council and stated his department mows between 50 and 60 acres. Some of our properties have been baled but he would like to start keeping them mowed. The aldermen were provided two quotes, one from Carter Turf and Tractor and the other was from John Deere. Both of the quotes were to lease the tractor and mower for 5 years and own the mower at the end of the lease. The lower quote was from Carter Turf and Tractor. The Council could require bids for this type of purchase or they can authorize the purchase with a 2/3 vote. If this mower is purchased we will keep our properties mowed and we will no longer be baling. A motion was made by Alderman Moore, seconded by Alderman Lampley to purchase the equipment from Carter Turf and Tractor for $67,275.00 with the five year lease option. The lease payments will be an annual payment of $14,624.51.

TIF Ordinance – Gas Department Request for Gas Meters – The Gas Department has requested to purchase gas meters for locations within the TIF District. The total cost request is $4,478.23. The TIF Committee has met and they are recommending Council approve 75% of the project, for $3,210.00 of the total cost. A motion was made by Alderman Lampley, seconded by Alderman McGill to approve the ordinance authorizing a TIF Redevelopment Project for the purchase of gas meters.

Mayor Maguire declared motion carried and Ordinance No. 20-0623-216 approved and duly adopted.

TIF Ordinance – Water Department Request for Replacement of Water Meters – We have a request from the Water Department to purchase smart meters to finish the replacement of water meters within the TIF District. The total cost for replacing those meters is $57,485.00. The TIF Committee is recommending that the City utilize TIF funds to pay for 75%, or $43,113.75, of the total cost. A motion was made by Alderman Lampley, seconded by Alderman Moore to approve the ordinance authorizing a TIF Redevelopment Project for the purchase of water meters.

Mayor Maguire declared motion carried and Ordinance No. 20-0623-217 approved and duly adopted.

Recreation Board Appointment – Mayor Maguire would like to appoint Henry Simmers to the Recreation Board for a three year term. Motion by Alderman Barbre, seconded by Alderman Moore to approve this appointment.

Mayor Maguire declared motion carried and Resolution No. 20-0623-351 approved and duly adopted.

Library Board Appointment – Mayor Maguire would like to appoint Kayla Warren to the Library Board to fill the unexpired term of Julie Duncan. This term will expire May, 2022. Motion by Alderman McGill, seconded by Alderman Stahl to approve this appointment.

Mayor Maguire declared motion carried and Resolution No. 20-0623-352 approved and duly adopted.

Miscellaneous – Alderman McGill thanked Officer Charlie McMeen for his service to the Fairfield Police Department. He will be retiring after 20 years with the department.

Miscellaneous – Alderman Barbre asked about the status of the Casey’s project along Main Street and thinks there are some dangerous areas that needs attention. Flo Simpson stated she has heard they haven’t received a release-to-build date but will make contact with them to find out the status.

Miscellaneous – Alderman Coale reported the Economic Development Committee has had their first meeting and several good ideas were discussed. They will have their next meeting July 8th.

Miscellaneous – Alderman Moore brought up Betty Ray’s request. He said there are several trees in the city that needs trimmed or cut down. Many of them are causing a safety hazard and he recommended the City consider hiring a contractor to take care of these trees to eliminate the liability. Alderman Lampley suggested we develop clear guidelines to make sure it is something that can be fairly and consistently followed.

Miscellaneous – Mayor Maguire reminded the Council that July 2nd will be Wayne County Law Enforcement Appreciation Day. A motion was made by Alderman Barbre, seconded by Alderman Moore to approve a motion of support for law enforcement and all first responders.

Executive Session – Alderman Moore made a motion, seconded by Alderman McGill to go into Executive Session to discuss Section 2(c)(21) – discuss minutes of closed session meetings and Section 2(c)(1) – the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body.

Return to Regular Session – Alderman Lampley made a motion, seconded by Alderman McGill to return to regular session.

Resolution No. 20-0623-353/Release of Executive Session Minutes – Alderman Moore made a motion, seconded by Alderman Coale to approve Resolution No. 20-0623-353 regarding the release of executive session minutes.

Resolution No. 20-0623-354/Authorizing Destruction of Recordings – Alderman Stahl made a motion, seconded by Alderman Moore to approve Resolution No. 20-0623-354 authorizing the destruction of audio recordings for closed session meetings.
