City of Fairfield Council met Aug. 11.

Here is the minutes provided by the council:

The City Council meeting was held with in-person attendance and others joined the meeting via phone conference.

Meeting called to order by Mayor Maguire at 6:00 P.M.

Prayer led by Mayor Maguire followed by the Pledge of Allegiance.

The minutes of the meeting of July 28, 2020, agendas and bills of August 11, 2020 were sent out to those entitled to receive them. Mayor Maguire asked for approval of the minutes for the July 28, 2020 meeting. Motion by Alderman Stahl, seconded by Alderman McGill to approve the minutes of the meeting of July 28, 2020.

Mayor Maguire declared motion carried.

Mayor Maguire asked for approval to pay the bills for the August 11, 2020 meeting. A motion was made by Alderman Barbre, seconded by Alderman Coale to approve the bills for payment.

Vote no: none

Mayor Maguire declared motion carried.

Ordinance /Rezone Property at 1108 Leininger Rd. – A public hearing was held earlier to consider a request by Dean Kieffer to rezone property located at 1108 Leininger Rd. from an R-1 zone to an R-3 zone. He plans to turn the home into student housing for Frontier’s baseball players. Alderman Griffith stated that as he understands it if the property remained as an R-1 zone up to five students would still be allowed to live there. Attorney Rice stated that an R-1 zone provides for a single family dwelling. The definition of family in our code states that one or more persons occupying a single housekeeping unit using common cooking facilities provided that unless all members are related by blood or marriage, no family shall contain over five members. With no other questions, Mayor Maguire asked if there was a motion to approve this request. No motion was made so this ordinance died for lack of a motion.

Ordinance No. 20-0811-222/Rezone Property at 1301 West Delaware St. – A public hearing was held earlier to consider a request to rezone property at 1301 West Delaware Street from an R-2 to a B-3 zone. McDonald’s has plans to purchase this property to use as a parking lot for employees. A motion was made by Alderman Coale, seconded by Alderman Stahl to approve this rezone request.

Mayor Maguire declared motion carried and Ordinance No. 20-0811-222 approved and duly adopted.

Supplemental Resolution Appropriating MFT Funds for Street Project – Previously the Council appropriated Motor Fuel Tax money to be used for making repairs to NW 10th Street. The bid on that project came in too high and the Council rejected those bids. Since that time we added additional streets to the project and recently awarded a bid in the amount of $312,141.34. We need to appropriate an additional $225,000.00 for the total project. A motion was made by Alderman Barbre, seconded by Alderman Moore to approve the resolution appropriating additional MFT Funds in the amount of $225,000.00 for the street resurfacing project on portions of NW 10th Street, Mt. Vernon Rd., SW 6th Street and North Street.

Mayor Maguire declared motion carried and Resolution No. 20-0811-356 approved and duly adopted.

Census Bureau Update – Mayor Maguire stated that as of August 7th we have only had about 67.8% response. He encouraged those who have not completed the census form to do so.

Letter of Resignation from Mayor Maguire – Mayor Maguire read a letter of resignation. He will be leaving to accept a position at Oakland City University. The effective date of his resignation will be at 11:59 p.m. on August 23, 2020. City Clerk Hutchcraft presented a plaque of appreciation to Mayor Maguire for his service to the City of Fairfield.

Resolution Approving the Appointment of an Alderman to Serve as Acting Mayor – As a result of the resignation of Mayor Maguire, the Council will need to appoint a member to serve as Acting Mayor to fill the vacancy in the office of Mayor and the unexpired term of Mayor Maguire. Alderman Coale stated that the City of Fairfield is a $17 million business and he thinks the position should be full-time. He believes a full-time mayor is best because we have an obligation to the residents as well as the city employees. Attorney Rice explained the procedure required to appoint an Acting Mayor. A motion was made by Alderman Lisenbee to nominate Gary Moore to the position of Acting Mayor. The appointment would be effective August 24, 2020. This motion was seconded by Alderman Stahl.

Abstain: Moore

Mayor Maguire declared motion carried and Resolution No. 20-0811-357 approved and duly adopted. Alderman Moore stated the City of Fairfield has some very strong employees and he looks forward to working with everyone and the community as a whole.

Miscellaneous – Alderman McGill stated it has been a privilege to work with Mayor Maguire and thanked him for his dedication to the City of Fairfield.

Miscellaneous – Alderman Griffith asked about the status of municipal court. The first date for municipal court is scheduled for August 25th. Those that have received tickets can avoid going to court by paying their fine prior to the court date.

Miscellaneous – Mayor Maguire informed the Council that Officer Craig Zurliene will be leaving to accept a position with the Vincennes Police Department.

Executive Session – Alderman Moore made a motion, seconded by Alderman Lampley to go into Executive Session to discuss Section 2(c)(21) – discuss minutes of closed session meetings;

Section 2(c)2 – collective negotiation matters; and Section 2(c)(1) – the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body.

Mayor Maguire declared motion carried.

Return to Regular Session – Alderman McGill made a motion, seconded by Alderman Coale to return to regular session.

Mayor Maguire declared motion carried and Council returned to regular session at 7:27 p.m.
