Illinois judge rules firearm ban unconstitutional; appeals expected

A federal judge in Southern Illinois has ruled that a semi-automatic firearms and magazine ban, enacted by the previous General Assembly, is unconstitutional. The decision was made by Judge Stephen McGlynn of the US District Court for the Southern District of Illinois.

State Representative Patrick Windhorst, a Republican from Metropolis and House Republican Floor Leader, responded to the ruling with a statement on Friday afternoon. Windhorst has been a vocal opponent of the legislation, which he argues infringes on constitutional rights.

"As many people are aware, I was a leading advocate against Illinois Democrats’ unconstitutional semi-automatic firearms and magazine ban," Windhorst stated. "Today’s decision by Judge McGlynn affirms my contention that the law is unconstitutional, as it bans many firearms that are in common use by law-abiding gun owners."

Windhorst acknowledged that while this ruling represents a victory for constitutional rights, there remains potential for further legal developments. "While this is a victory for our Constitutional Rights, I am aware that a stay has been issued in this ruling that will allow time for advocates of the ban to appeal," he noted. "I will continue to keep my constituents updated as higher courts likely issue rulings in this case in the coming months."

The case may proceed through higher courts as those supporting the ban consider their options for appeal.
