State Representative Patrick Windhorst, a Republican from Metropolis, expressed his opposition to Senate Bill 8 and House Bill 850 after casting a 'no' vote late Wednesday. As the House Republican Floor Leader, Windhorst raised constitutional concerns regarding the rights of gun owners.

Windhorst criticized Senate Bill 8, known as the Safe Gun Storage Act, describing it as an "overreaching and constitutionally dubious attempt" to limit Second Amendment rights. He argued that the bill imposes "excessive and confusing firearm storage mandates," potentially leading to legal risks for responsible gun owners.

The proposed legislation requires firearms to be stored in locked containers when minors or prohibited individuals are present. Windhorst pointed out that these requirements could create complications for hunters, target shooters, and youth shooting clubs due to its conflicting provisions.

Windhorst further commented on the Democrats' approach: “Democrats have pushed a law that is not only unworkable but also invites legal challenges by contradicting recent U.S. Supreme Court rulings affirming individual gun rights.” He added that SB 8 could unfairly penalize those who already practice safe firearm storage.

Additionally, SB 8 includes a mandate for reporting stolen firearms within 48 hours or facing civil penalties. Windhorst highlighted an issue with non-residents having greater Second Amendment rights while transporting firearms through Illinois compared to state residents.

On House Bill 850, Windhorst voted against amendments affecting Illinois’ Clear and Present Danger statute. He claimed these changes remove due process protections and risk further constitutional violations. "HB 850 was rushed to the House Floor without a public Committee hearing," said Windhorst. He argued it allows for revoking FOID cards without proper hearings, infringing on Second Amendment rights and due process.

Throughout his career, Rep. Windhorst has advocated for law-abiding citizens' rights by opposing measures he views as unconstitutional threats to Second Amendment freedoms.
