Illinois Human Rights Commission reviews case requests

The Illinois Human Rights Commission met July 20 to review case requests.

Here are the meeting's minutes, as provided by the commission:

The Commission adjudicates charges of civil rights violations in employment, housing, public accommodations and financial credit filed with Department of Human Rights.

I. Call to Order

A meeting of the Illinois Human Rights Commission Panel D was called to order on Wednesday, July 20, 2016 at 9:40 a.m. by Panel Chair Fakroddin.

Pursuant to the Illinois Open Meetings Act, 5 ILCS 120/1 et seq. and 775 ILCS 5/8-103 of the Illinois Human Rights Act, it was determined that:

1) All three Commissioners were physically present at the meeting.

II. Minutes

The minutes from the meeting of May 25, 2016 were approved as submitted by staff. Motion to approve the May 25, 2016 minutes made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

III. Contested Matters

A. Makisha Motley v. Roy J. Beard, Jr.

Charge No.: 2006SN3945 ALS No.: S08-0277

Panel D declined review of the above referenced matter. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

B. Anita J. Lomax v. Roy J. Beard, Jr.

Charge No.: 2006SN3636 ALS No.: S08-0272

Panel D declined review of the above referenced matter. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

IV. Requests for Review

A. Mohammad H. Patel v. Wal-Mart Stores

Charge No.: 2010CN4336 ALS No.: 12-0499

Panel D sustained the dismissal of the above referenced matter for Lack of Substantial Evidence. Motion made by Commissioner Fakroddin, P.E., S.E.; seconded by Commissioner Hartman. Motion carried 3-0.

B. David Pickett v. Archer Daniels Midland

Charge No.: 2011SA0393 ALS No.: 12-0511

Panel D sustained the dismissal of the above referenced matter for Expiration of Time to File a Complaint with the Illinois Human Rights Commission. Motion made by Commissioner Hartman; seconded by Commissioner Gash. Motion carried 3-0.

C. Carlos Romero v. NEP Electronics Inc.

Charge No.: 2011CF3247 ALS No.: 12-0514

Panel D sustained the dismissal of the above referenced matter for Lack of Substantial Evidence. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

D. Minerva Pagan v. Thomas Tuccori & Cathy Tuccori

Charge No.: 2012CH1061 ALS No.: 12-0517

Panel D sustained the dismissal of the above referenced matter for Lack of Substantial Evidence. Motion made by Commissioner Fakroddin, P.E., S.E.; seconded by Commissioner Gash. Motion carried 3-0.

E. Racine Robinson v. Decatur Memorial Hospital

Charge No.: 2012SN0517 ALS No.: 12-0482

Panel D sustained the dismissal of the above referenced matter for Lack of Substantial Evidence. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

F. Irma J. Kelley v. Home Solutions Network, LLC

Charge No.: 2012CH2084 ALS No.: 12-0494

Panel D sustained the dismissal of the above referenced matter for Lack of Substantial Evidence. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

V. Motion to File a Request for Review in Excess of 30 Pages

A. Linda Liu v. MESIROW Financial Administration Corp. Charge No.: 2014CA3245 ALS No.: 16-0222

Panel D granted the party’s Motion to File a Request for Review in Excess of 30 Pages, and granted Liu an additional sixty (60) pages for a total of ninety (90) pages in which to file her Request for Review. Motion made by Commissioner Fakroddin, P.E., S.E.; seconded by Commissioner Hartman. Motion carried 3-0.

VI. Motion for Extension of Time to File a Request for Review

A. Linda Liu v. MESIROW Financial Administration Corp. Charge No.: 2014CA3245 ALS No.: 16-0222

Panel D granted the party’s Motion for Extension of Time to File a Request for Review, and granted Liu an additional sixty (60) days from the date of service of this order by which to file a Request for Review. Motion made by Commissioner Hartman; seconded by Commissioner Gash. Motion carried 3-0.

VII. Motion for Leave to Subpoena Documents

A. Robert Jakubowski v. SOI-Department of Corrections

Charge No.: 2012SF1530 ALS No.: 13-0174

Panel D denied Jakubowski’s Motion for Leave to Subpoena Documents. Motion made by Commissioner Hartman; seconded by Commissioner Gash.

VIII. Third Request for Additional Time to File a Reply to a Response to a Request for

Review

A. Edie Mathers and Joseph Mathers v. Marina Towers Condo Association and Draper

and Kramer Charge No.: 2015CH0731 ALS No.: 15-0340

Panel D struck the Third Request for Additional Time to File a Reply to a Response to a Request for Review because it was moot, and issued order for the same from the May 25, 2016 Panel D meeting, which order had not gone out prior to the filing of the instant motion.

Issuance of that order rendered the instant motion moot. Motion made by Commissioner Gash; seconded by Commissioner Hartman. Motion carried 3-0.

IX. Adjournment

The July 20, 2016 Panel D meeting was adjourned at 10:25 a.m. Motion made by Commissioner Hartman; seconded by Commissioner Gash. Motion carried 3-0.
